These terms and conditions (“Agreement”) govern your use of the car rental services provided by Harmon Rentals, LLC (“Company”) through its website (“HarmonRentalsLLC.com”). By accessing or using the Website, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you should not access or use the Website.
- Rental Agreement
1.1 The rental agreement between the Company and the customer is formed when the customer completes the online reservation process and receives a confirmation email.
1.2 The customer must provide accurate and complete information during the reservation process, including personal information, driving destination, towing vehicle type, and payment details.
1.3 The customer must meet all the eligibility requirements, including minimum age and valid driver’s license, as specified by the Company.
- Rental Period and Returns
2.1 The rental period begins at the agreed pick-up time and ends at the agreed drop-off time as stated in the reservation.
2.2 The customer must return the rented trailer to the designated drop-off location at the agreed time and in the same condition as received.
2.3 Late returns may incur additional charges as specified in the reservation or rental agreement. The customer could be held liable for lost revenue and other costs of the additional time taken to return as it interferes with other bookings.
- Vehicle Condition and Use
3.1 The customer is responsible for inspecting the vehicle before accepting it and reporting any pre-existing damage or issues to the Company.
3.2 The customer must use the rented vehicle in a responsible and lawful manner, following all applicable traffic laws and regulations.
3.3 The customer is responsible for any damage caused to the vehicle during the rental period, including damage due to negligence, misuse, or accidents.
- Rental Charges and Payment
4.1 The customer agrees to pay the rental charges as specified in the reservation or rental agreement, including base rental rates, additional fees, taxes, and surcharges.
4.2 Payment can be made through the accepted payment methods as specified on the Website.
4.3 The customer authorizes the Company to charge the provided payment method for the rental charges and any additional fees or charges incurred during the rental period.
- Cancellations and Modifications
5.1 Cancellations and modifications to the reservation must be made in accordance with the Company’s cancellation policy, as stated on the Website or in the reservation confirmation.
5.2 The Company reserves the right to cancel or modify a reservation in case of unforeseen circumstances, such as unavailability of the requested vehicle or changes in rental terms.
5.3 Renters are entitled to a full refund for all cancellations made up to 30 days prior to the rental start date.
5.4 Renters are entitled to a 50% refund for all cancellations made up to 14 days prior to the rental start date.
5.5 The booking is non-refundable if cancelled less than 14 days prior to the rental start date.
5.6 A 24-hour cancellation grace period is given to all bookings made at least 7 days prior to the rental start date.
5.7 For all bookings made within 7 days of the rental start date, a 1-hour grace period is given.
5.8 If a booking is cancelled during a grace period a full refund is granted.
5.9 The Company will be issuing Security Deposit refunds 24 to 48 hours upon return of the rental as long as there are no issues or structural damage with the trailers.
5.10 If there are issues with the trailers, documentation supporting issues/damages will be sent to the renter within 24 to 48 hours of return
- Limitation of Liability
6.1 The Company shall not be liable for any loss, damage, or inconvenience caused by the customer’s use of the rented vehicle, including accidents, injuries, or theft.
6.2 The Company shall not be liable for any loss, damage, or inconvenience caused by circumstances beyond its reasonable control, including natural disasters, strikes, or government actions.
- Responsibilities and Prohibitions
7.1 Vehicle Usage: You agree to use the vehicle responsibly, abide by traffic laws, and operate the vehicle within its intended purpose. Prohibited uses include but are not limited to:
a) Use of the vehicle for any illegal activities.
b) Unreasonable Off-road driving.
c) Transporting hazardous materials.
d) Overloading the vehicle beyond its capacity.
e) Renting the vehicle to a third party.
7.2 Condition: You are responsible for maintaining the trailer in good condition throughout the rental period. You must promptly report any accidents, damages, or mechanical issues to us.
- Privacy and Data Protection
8.1 The Company collects and processes personal information provided by the customer in accordance with its Privacy Policy, which is available on the Website.
8.2 The customer acknowledges and agrees that the Company may use their personal information for the purpose of facilitating the rental services and communicating with the customer.
- Governing Law and Jurisdiction
9.1 This Agreement shall be governed by and construed in accordance with the laws of the state of Utah.
9.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the state of Utah.
- Severability
10.1 If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
- Amendments
11.1 The Company reserves the right to modify, update, or change these terms and conditions at any time without prior notice. The updated terms and conditions will be posted on our Website, and your continued use of our services constitutes your acceptance of such changes.
